Supreme Court refuses to Hear Case on Environmentalist Appeals to Stop Border Fence


Not only Is This an Important Decision in Terms of Border Enforcement but Also Deals with an Aspect of What We Were Discussing in Connection with Rectifying the Courts Guantánamo Detainees Decision.

Some of You May Recall That Congress Passed As Part of the Fence Building Initiative a Jurisdiction Limiting Clause That Prevented the Courts from Interfering on the Basis of Environmental Lawsuits, with the Fences Construction.

So This Decision Not Only Assists in Building the Fence but Strengthens the Argument by the Courts Lack of Action That Congress under Article III Section 2 of the Constitution Can Limit All the Federal Courts Jurisdiction on Certain Matters.
